GOVERNING
BODIES AND MANAGING COMMITTEES
OF EDUCATIONAL INSTITUTIONS UNDER THE
BRAHMO SAMAJ EDUCATION SOCIETY
CONSTITUTION
AND RULES
Section
1
(a) The composition of Governing Bodies/Managing
Committee shall be as follows:
I. GOVERNING BODIES
(i) 10 members elected from among the members of the Brahmo Samaj
Education Society by the Council of the Brahmo Samaj Education Society
(of which at least 5 shall be members elected to the Council by
the Executive Committee of Sadharan Brahmo Samaj and the Brahmo
Samaj Education Society and none shall belong to the particular
Institution concerned);
(ii) 1 The Principal ex-officio (to be Secretary)
(iii) 2 The Heads of the Colleges in the same building of whom the
Senior Principal shall be the Joint-Secretary.
(iv) Two representatives elected by permanent teachers of two years'
standing from among themselves, provided that no teacher shall exercise
his franchise more than once ; in case of Colleges affiliated upto
B. Sc. standard one of them shall be from among science teachers;
in case of women's Colleges at least one of them shall be from among
women teachers.
(v) 1 One additional member to be co-opted, subject to the approval
of the Council. The Council shall appoint a Chairman from among
members elected by it, who shall preside over the meetings of the
Governing Body.
Section
3
(a) The Governing Bodies/Managing Committees of the Educational
Institutions under the Brahmo Samaj Education Society (hereinafter
called the Governing Bodies) shall,with the reservations mentiohed
in Rule 6 of the Rules of the Brahmo Samaj Education Society and
the provisions stated in Sections 3—6 of this present Constitution,
exercise all the powers necessary for the efficient discharge of
their duties as Governing Bodies of the Institutions placed in their
charge.
(b) Without restricting the generality of the foregoing powers,
the Governing
Bodies shall be competent to:
(1) Establish or acquire boarding houses or hostels in connection
with the
Institutions under their management, provided that such establishment
or acquistion does not affect the financial obligations to the Council.
(2) Appoint teachers, professors and other officers or other employees
of the
Institutions for the purpose of carrying on its work upon such terms
and conditions as they may think proper, provided that
(i) the appointment of Principals or the Headmaster shall be made
by the Council on the recommendation of a Selection Committee appointed
by it, on which the Governing Body will be represented.They shall
be whole-time officers. In case of purely Commerce Colleges, they
may, in very special cases, be permitted by the Council, to continue
their professions, if any, outside their duty hours and without
causing any interference with the administration of the College.
(ii) the appointment of Heads of Departments shall be made by the
Governing Body on the recommendation of a Selection Committee appointed
by it in which outside experts will be included
(iii) the appointment of all employees not below the Lecturer's
grade shall ordinarily be made by the Governing Body on the recommendation
of a Selection Committee appointed by it;
(iv) the appointment of all other employees shall be made in the
manner as the Governing Body may consider fit and proper.
(3) Suspend or dismiss any of the teachers, professors, officers
or other employees of the Institution and upon such terms and conditions
as they may consider fit and proper, subject to a right of appeal
to the Council,
(4) Frame rules regarding service conditions, Provident Fund, Leave
Rules etc.
(5)
Sell, let, exchange or otherwise dispose of absolutely or conditionally
any movable property exclusively belonging to the Institution and
not required for the purposes of the Institution.
(6) Enter into any arrangement with the Government, the University
or the University Grants Commission for financial assistance - subject
to the prior approval of the Council.
(7) Enter into any arrangement for sharing work, union of interest
or cooperation with educational Institutions under the Brahmo Samaj
Education Society.
(8) Subject to the approval of the Council, appoint in order to
execute any instruments or transact any business any person as attorney
of the Institution with such powers as they may deem necessary.
(9) Subject to the approval of the Council to transpose or alter
any securities given for the debts or obligations of the Institution.
(10) Make, draw, accept, endorse and negotiate respectively promissory
notes, bills, cheques or other Negotiable Instruments, provided
that all such Instruments drawn, made or accepted shall be signed
by one member of the Governing Body specially appointed for the
purpose and by the Secretary.
(11) Invest the funds of the Institution in or upon such securities
(approved by the Council for the purpose) as they deem fit and from
time to time transpose any such investment.
(12) Make such grants as they may think proper for the benefit of
any employee or employees of the society provided that (a) no departure
is made from the established salary scales without the consent of
the Council and (b) no such grant affects the financial obligations
of the Institution to the Council.
(13) Make grants of a sum not exceeding 200/- in all in one year
in furtherance of any beneficial, philanthropic or useful object
unconnected with the Society.
(14) Create and invest trust funds for approved purposes subject
to the prior approval of the scheme by the Council.
Section - 7 Transitory Regulations:
(1) All orders, Rules, procedure etc., in existence or in operation
on the date
powers are transferred from the Council to the Governing Bodies,
shall continue until modified or rescinded by the relevant Governing
Body.
(2) No member of the staff of any category shall be adversely affected
as far as his basic salary is concerned by the tranfer of powers
from the Council to the Governing Body

Certified
that this is a correct copy of the Rules and Regulation of the Brahmo
Samaj Education Society.
At present, the following Institutions are under the Society : City
College School, City College, City College of Commerce and Business
Administration, Umesh Chandra College, Anandamohan College, Prafulla
Chandra College, Rammohun College, Heramba Chandra
College and Sivnath Sastri College.
